Agreed in writing before we start. Here is what that covers.
The short version: we agree the price and the scope in writing before anything starts. You own what we build. If something is unclear here, ask before we begin rather than after.
happyday creative co. is a studio in Orlando, Florida, working with venues across Florida. "We" and "us" below means that studio; "you" means the business we're working for.
Prices on this site are a guide. The quote we send you is the real one: it lists the price, what's included, what we need from you and when it will be delivered. Where the quote and this page disagree, the quote wins.
Promotional prices, including the launch price on websites, are temporary and can be withdrawn at any time. Once your quote is issued, the price on it is held for 30 days.
Menu design includes a print-ready PDF and the matching web version. GoldenBuzz listings are month to month and can be cancelled with 30 days' notice; we remove the listing at the end of the paid period.
$39 a month, month to month, cancellable at any time. It covers small changes — prices, hours, a dish added or dropped, photos, specials — turned around the same working day where possible. It isn't a redesign service; larger work is quoted separately.
Content you send us must be yours to use. If you send us a photo or a font we can't legally use, we'll say so before we build with it.
Payment terms are set out in your quote. Work starts once the first payment in the quote clears. If a project is cancelled after work has begun, we bill for the work completed to that point and hand over anything finished.
When the invoice is paid, you own the finished site, menu files and artwork. We keep the right to show the work in our portfolio and on social media unless you ask us not to in writing — say so and we won't.
We keep our own working files and templates, and we don't transfer the underlying tools we use to build with.
We build well and we build fast, but we can't promise a position in Google, a number of bookings, or a sales figure. Nobody honestly can. We also aren't responsible for outages at your host, your registrar or any other third party.
If something goes wrong on our side, our responsibility is limited to putting it right or refunding what you paid us for the work in question. We aren't liable for lost profit or indirect losses.
The care plan can be cancelled any time with no penalty. A project can be cancelled by either side in writing; you pay for work done up to that point and we hand over what's finished.
These terms are governed by the laws of the State of Florida, and any dispute belongs in the courts of Orange County, Florida.
